These Terms of Service ("Terms") govern your access to and use of the website at shop.thirdageplastics.com and thirdageplastics.com (the "Site") and your purchase of products and custom services from Third Age Plastics & Design ("Third Age," "we," "us," or "our"), a business located in Hamilton, New Jersey, United States. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or place an order.
We may update these Terms from time to time. Changes take effect when posted, and the "Effective date" above will reflect the most recent revision. Your continued use of the Site after changes are posted means you accept the updated Terms.
1. Who can order
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By ordering, you represent that you meet this requirement and that the information you provide is accurate and complete.
2. Products, descriptions, and pricing
We sell handmade and made-to-order 3D-printed goods and related items. We try to describe and photograph products accurately, but we do not warrant that descriptions, colors, dimensions, images, or other content are error-free, complete, or current.
All prices are in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing errors, limit order quantities, and refuse or cancel any order — including after an order has been submitted — for reasons that include suspected error, fraud, or product unavailability. If we cancel an order you have already paid for, we will refund you in full.
3. The nature of handmade, 3D-printed goods
Our products are produced using additive manufacturing (3D printing). Because each item is made individually, you acknowledge and accept that:
- Minor variation in color, finish, surface texture, and layer lines is inherent to the process and is not a defect.
- Dimensions are approximate and may vary within normal manufacturing tolerances.
- Materials (such as PLA, PETG, and similar plastics) have practical limits on heat resistance, load capacity, chemical resistance, and durability.
Intended use. Unless we agree otherwise in writing for a specific order, our products are sold as decorative or general-purpose functional items. They are not designed, tested, or certified for safety-critical, load-bearing, structural, medical, food-contact, electrical, automotive, aerospace, or high-temperature applications. You are responsible for determining whether a product is suitable for your intended use, and you assume all risk arising from use beyond its intended purpose.
4. Custom and made-to-order work
We offer custom and personalized work, typically quoted and invoiced through a payment link (draft order) before production begins.
- Quotes and approval. A custom order proceeds once you approve the quote and complete payment (or an agreed deposit). Production timelines ("lead times") are estimates, not guarantees.
- Customer-supplied designs and files. If you provide a design, model, logo, text, or other material for us to produce, you represent and warrant that you own it or have all rights and permissions necessary to use it and to have it manufactured. You agree to defend, indemnify, and hold Third Age harmless from any claim that your supplied material infringes a patent, copyright, trademark, trade secret, or other right, or violates any law. We may decline any custom request at our discretion, including requests we believe may infringe third-party rights.
- Custom orders are final. Because custom, personalized, and made-to-order items are produced specifically for you, they are not eligible for return, exchange, or refund except where the item arrives defective or materially different from the approved specification. 5. Orders, acceptance, and payment
Your submitted order is an offer to buy. A confirmation email acknowledges receipt but does not by itself constitute our acceptance; acceptance occurs when we process payment and begin fulfillment. Payment is due at the time of purchase unless we agree otherwise in writing.
We accept payment through our payment processors, including Shopify Payments and any other methods shown at checkout or on an invoice. In-person sales may be processed via contactless payment. You authorize us and our processors to charge your selected payment method for the total order amount, including applicable taxes and shipping.
6. Taxes
We charge sales tax where required, including on applicable sales within New Jersey. You are responsible for any additional taxes, duties, or import fees imposed by your jurisdiction.
7. Shipping, delivery, and risk of loss
We ship to the addresses and regions shown at checkout. Shipping timeframes are estimates and are not guaranteed. You are responsible for providing an accurate shipping address; we are not responsible for orders delayed or lost due to an incorrect address you provided.
Risk of loss passes to you upon our delivery of the item to the carrier. Claims for items lost or damaged in transit may be subject to the carrier's process. Local pickup, where offered, is available on the terms stated at checkout.
8. Returns and refunds
Returns and refunds are governed by our separate Refund Policy, which is incorporated into these Terms by reference. In general, custom, personalized, and made-to-order items are final sale except where they arrive defective or not as specified. To report a problem, contact us at the email below within 30 days of delivery with your order number and photos.
9. Intellectual property
All content on the Site — including our product designs, original 3D models, text, graphics, logos, and photographs — is owned by Third Age or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our original designs or content, or reproduce our physical products for resale, without our written permission. Purchasing a product grants you ownership of that physical item only, not any rights in the underlying design.
10. Acceptable use of the Site
You agree not to use the Site to break any law, infringe anyone's rights, transmit harmful code, interfere with the Site's operation, or attempt unauthorized access to our systems or data.
11. Disclaimer of warranties
Except for any limited warranty we state in writing for a specific order, and except for warranties that cannot be excluded under applicable law, the Site and all products and services are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, Third Age and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of or related to your use of the Site or any product or service, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for any claim arising out of or related to an order will not exceed the amount you paid for that order.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Third Age and its owner from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of a product, or — for custom work — any material or instructions you supplied to us.
14. Governing law and disputes
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in New Jersey will have exclusive jurisdiction over any dispute arising out of or relating to these Terms, the Site, or your orders, and you consent to venue in those courts. Nothing here waives any non-waivable consumer right you have under the law of your home jurisdiction.
15. Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with our Refund Policy and Privacy Policy, are the entire agreement between you and Third Age regarding the Site and your orders, and supersede any prior understandings.
